These terms govern your use of the Citypins mobile web app and related services (the “Service”). The Service is provided by Victor Nketiah, Steglitzer Straße 7, 22045 Hamburg, Germany, trading as “Citypins” — the seller you contract with (referred to as “we”, “us”, “our”), reachable at citypinsofficial@gmail.com. By creating an account or continuing to use the Service, you enter into a binding agreement with Citypins and agree to these terms. If you are using Citypins on behalf of an organisation, you confirm you have authority to bind it; if you use it as an individual, you confirm you are of legal age in your country.
1. The Service
Citypins is a location-based discovery app. Private users can see nearby events, aggregated area activity, posts from other users and friends who choose to share their location. Business and organiser accounts can publish event listings for a paid visibility duration, optionally boost them, and subscribe to Citypins Premium.
2. Your account
- Provide accurate information and keep it up to date.
- Keep your login credentials confidential; you are responsible for activity on your account.
- You may switch between a private and a business account at any time in your profile.
3. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for anything unlawful, or to harass, stalk or endanger another person;
- post fraudulent, spam, misleading or fake event listings;
- upload content that infringes anyone's intellectual property or privacy rights;
- interfere with security — no malware, probing, automated scraping or circumvention of technical limits;
- reverse engineer, resell or redistribute the Service.
Because Citypins handles location data, deliberately misrepresenting a location or using the app to track someone without consent is a serious violation.
4. Your content
You keep ownership of the posts, event details and flyer images you upload. You grant us a limited, non-exclusive licence to host, resize and display that content solely to operate the Service. You confirm you have the rights to everything you upload, including flyer artwork. If you believe content on Citypins infringes your rights, contact us and we will review and, where appropriate, remove it. Repeat infringers lose access.
5. Our intellectual property
We retain all rights in the Service, including its software, design, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
6. Payments, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, currency, tax, renewal and cancellation mechanics are governed by Paddle's Buyer Terms. Paid event listings are one-off purchases for the visibility duration you select. Citypins Premium is a recurring monthly subscription that renews until cancelled.
7. Availability
We work to keep Citypins reliable, but we do not guarantee uninterrupted or error-free performance. Maps, geolocation and third-party data may be inaccurate or temporarily unavailable.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time; unpublished or expired listings are removed from the map.
9. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including lost profits, data or goodwill, and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not permit it.
10. Indemnity
You indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
11. General
You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will change the “last updated” date above. Disputes are handled by the courts of the seller's jurisdiction under its local law.
